Terms of Service

1. Who we are

The AiVironment Marketplace (the “Service”) is operated by QASTTOR — Paweł Magdański, a sole proprietorship registered in Poland.

We are referred to in these Terms as “we”, “us”, or “Qasttor”. “You” means the natural or legal person using the Service.

2. Acceptance and scope

By creating an account, listing a company, or programmatically accessing the Service via the public REST API or MCP server, you agree to be bound by these Terms and by our Privacy Policy. If you do not accept the Terms, do not use the Service.

These Terms apply to the entire Service, including the website at marketplace.aivironment.ai, the REST API at api.marketplace.aivironment.ai, and the MCP server at mcp.marketplace.aivironment.ai.

4. Accounts and authentication

Sign-in is provided exclusively through Google. We rely on Google’s assertion that the email address associated with your Google account is verified. You are responsible for the security of the Google account you use to sign in. Do not share your account.

We may suspend or terminate an account at our discretion in response to violations of these Terms, suspected fraud, or legal obligation.

5. Listings and your content

You retain all rights to information you publish on the Service (company name, description, offerings, contact methods, images, etc. — collectively, “Your Content”). By publishing Your Content you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (only for formatting), publicly display, and distribute Your Content for the purposes of operating, promoting, and providing the Service. This license terminates when you delete Your Content, except to the extent necessary for backups or where retention is legally required.

You are solely responsible for the accuracy, lawfulness, and non-infringement of Your Content. We may — but are not obligated to — remove or refuse to publish Your Content if we reasonably believe it violates these Terms or applicable law.

7. Quote requests, MCP, and AI agents

The Service exposes a Model Context Protocol (MCP) server used by AI agents acting on behalf of buyers. By listing your company you consent to be reachable through this channel. Quote requests sent through the MCP server are subject to a per-recipient rate limit of five requests per hour per (company, requester email) pair, and the on-site agent endpoint is rate-limited to ten requests per minute per IP address. These limits exist to prevent abuse; we may adjust them without notice.

Agents are expected to identify themselves accurately in the requester_name field, supply a real reply-to email, and write specific, good-faith messages. Submissions that violate these expectations may be removed and the originating account or token suspended.

8. Verification and Premium

Companies marked verified have been validated by us as real and reachable; the badge is not an endorsement of quality. Companies marked premium have purchased a placement boost; placement is paid and disclosed and does not imply verification. We reserve the right to remove either status at any time, including if information changes or terms are violated.

9. Fees

The basic listing and the public REST/MCP read endpoints are free of charge today. We may introduce paid tiers in the future; if so, we will give you at least 30 days’ written notice (via the email address on your account or a banner in the Service) before any charges apply to you.

10. Intellectual property

All rights in the Service itself, including its software, design, trademarks, and the curated taxonomy, are owned by us or our licensors. Nothing in these Terms transfers any of those rights to you, except for the limited right to use the Service in accordance with these Terms.

11. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranty of any kind, whether express, implied, statutory, or otherwise, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or availability. We do not warrant that the Service will be uninterrupted, secure, or free of errors, or that any defects will be corrected.

12. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability arising out of or related to your use of the Service is capped at the greater of (a) one hundred euro (€100) or (b) the fees you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, business opportunities, or goodwill, even if advised of the possibility of such damages.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud, or wilful misconduct. Mandatory consumer rights under Polish law are not affected.

13. Indemnification

You agree to defend, indemnify, and hold us harmless from any claim, demand, loss, damage, cost, or expense (including reasonable attorneys’ fees) arising from (i) Your Content, (ii) your use of the Service in breach of these Terms, or (iii) your violation of applicable law or third-party rights.

14. Termination

You may stop using the Service at any time. To delete your account and the personal data we hold about you, email pmagdanski@qasttor.com (we will respond within 30 days as required by GDPR). We may suspend or terminate your access immediately if we reasonably believe you have materially breached these Terms or applicable law.

Sections that by their nature should survive termination (Intellectual property, Disclaimer, Limitation of liability, Indemnification, Governing law, and this Termination clause) survive termination.

15. Changes to these Terms

We may update these Terms from time to time. For non-material changes, we will update the effective date at the top of this page. For material changes (changes that meaningfully reduce your rights or expand your obligations) we will provide at least 30 days’ notice via a banner in the Service or by email. Continued use of the Service after the effective date of an updated version constitutes acceptance of the change.

16. Governing law and dispute resolution

These Terms are governed by the laws of the Republic of Poland, without regard to conflict-of-laws principles. Any dispute arising out of or in connection with these Terms or the Service shall be resolved by the common courts having jurisdiction over our registered seat (Bydgoszcz, Poland).

If you are an EU consumer, you may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
